1. Hizmetin "Olduğu Gibi" Sunulması
Propiq hizmetleri "olduğu gibi" ve "mevcut olduğu ölçüde" sunulmaktadır. Propiq; hizmetlerin kesintisiz, hatasız, güvenli veya belirli bir amaca uygun olacağına dair açık ya da zımni hiçbir taahhütte bulunmaz. Hizmete erişimin her zaman sağlanacağına dair garanti verilmez; planlı veya plansız bakım, teknik arıza ya da üçüncü taraf altyapı kesintileri sonucunda hizmet geçici olarak kullanılamaz hale gelebilir.
2. Kullanıcı Tarafından Girilen Verinin Doğruluğu
Propiq platformuna girilen tüm veriler (müşteri bilgileri, portföy detayları, fiyatlar, iletişim bilgileri ve benzeri) kullanıcı tarafından oluşturulur ve girilir. Propiq bu verilerin doğruluğunu, güncelliğini veya eksiksizliğini denetlemez ve garanti etmez.
- Yanlış, eksik veya yanıltıcı veri girilmesinden doğan her türlü zarar kullanıcıya aittir.
- Portföy ilanlarının ve müşteri taleplerinin doğruluğu, güvenilirliği ile güncelliğinin sorumluluğu tamamen ilgili kullanıcıya aittir.
- Propiq, platforma yüklenen içeriklerin üçüncü kişilerin haklarını ihlal etmediğini garanti etmez; bu tür ihlallerden doğan sorumluluk kullanıcıya aittir.
3. Yapay Zeka Destekli Özelliklerin Sınırları
Propiq'in sunduğu yapay zeka destekli özellikler (İlan Analizi, AI'ya Sor, Akıllı Eşleştirme, Günlük Brifing ve benzeri özellikler) bir yardımcı araç niteliğindedir ve aşağıdaki sınırlamaları taşır:
- AI çıktıları bilgi amaçlı olup öneri niteliğindedir; hukuki, finansal veya profesyonel tavsiye yerine geçmez.
- Piyasa analizleri ve fiyat tahminleri geçmiş verilere dayanır; gelecekteki piyasa koşullarını garanti etmez.
- Eşleştirme önerileri ve brifing içerikleri algoritmik değerlendirmeye dayalı olup kesin sonuç vaat etmez.
- Tüm nihai kararlar (satış, kiralama, fiyatlandırma, müşteri seçimi vb.) kullanıcıya aittir; Propiq bu kararlarda sorumluluk üstlenmez.
4. Platform Üzerindeki İşlemlerden Sorumluluk
Kullanıcılar, Propiq platformunu kullanarak gerçekleştirdikleri tüm işlemlerden (müşteri iletişimi, portföy paylaşımı, sözleşme süreçleri, satış ve kiralama faaliyetleri vb.) tamamen kendileri sorumludur.
- Platform üzerindeki her işlem ve eylemden doğan hukuki ve cezai sorumluluk kullanıcıya aittir; Propiq'in bu konuda herhangi bir sorumluluğu bulunmadığını kullanıcı kabul, beyan ve taahhüt eder.
- Propiq, kullanıcılar ile müşterileri arasındaki anlaşmazlıklara taraf olmaz ve bu anlaşmazlıklardan sorumlu tutulamaz.
- Kullanıcının platform üzerinden gerçekleştirdiği işlemlerin yürürlükteki mevzuata uygunluğundan kullanıcı sorumludur.
5. Üçüncü Taraf Hizmet Sağlayıcılar
Propiq, hizmetini sunmak için üçüncü taraf hizmet sağlayıcılardan (Supabase, Anthropic, Apple App Store, Google Play ve diğerleri) yararlanmaktadır. Bu sağlayıcılardan kaynaklanan kesinti, veri kaybı, hata veya güvenlik açıklarından Propiq'in sorumluluğu kanunen izin verilen azami ölçüde sınırlıdır.
- Apple veya Google aracılığıyla işlenen abonelik ödemelerinden kaynaklanan sorunlarda ilgili mağaza politikaları geçerlidir.
- Yapay zeka çıktıları üçüncü taraf model sağlayıcılarına dayanmaktadır; bu çıktıların doğruluğu için ek garanti verilmez.
6. Sorumluluk Sınırı
Yürürlükteki mevzuatın izin verdiği azami ölçüde Propiq, aşağıdaki zararlardan sorumlu tutulamaz:
- Doğrudan veya dolaylı zararlar (gelir kaybı, iş kaybı, veri kaybı, itibar kaybı vb.)
- Platformun geçici ya da kalıcı olarak kullanılamaz olmasından kaynaklanan zararlar
- Kullanıcının üçüncü kişilerle kurduğu ilişkilerden doğan zararlar
- Hizmetin beklentileri karşılamamasından kaynaklanan kayıplar
Propiq'in azami toplam sorumluluğu, zarara yol açan olaydan önceki 12 ay içinde kullanıcı tarafından ödenen abonelik bedeli ile sınırlıdır.
7. Beyanın Güncellenmesi
Bu Sorumluluk Reddi Beyanı, önceden bildirim yapılmaksızın güncellenebilir. Güncel metni her zaman bu sayfada bulabilirsiniz. Hizmeti kullanmaya devam etmeniz, geçerli beyanı kabul ettiğiniz anlamına gelir.

1. Service Provided "As Is"
Propiq services are provided "as is" and "as available." Propiq makes no express or implied warranty that the services will be uninterrupted, error-free, secure, or fit for any particular purpose. Access to the service is not guaranteed at all times; the service may be temporarily unavailable due to scheduled or unscheduled maintenance, technical failures, or third-party infrastructure outages.
2. Accuracy of User-Entered Data
All data entered into the Propiq platform (customer information, portfolio details, prices, contact information, etc.) is created and entered by the user. Propiq does not review or guarantee the accuracy, currency, or completeness of such data.
- Any damages arising from incorrect, incomplete, or misleading data entry are the user's responsibility.
- The accuracy, reliability, and currency of portfolio listings and customer inquiries are entirely the responsibility of the relevant user.
- Propiq does not guarantee that content uploaded to the platform does not infringe the rights of third parties; liability for such infringement lies with the user.
3. Limitations of AI-Powered Features
Propiq's AI-powered features (Listing Analysis, Ask AI, Smart Matching, Daily Briefing, and similar features) are auxiliary tools and carry the following limitations:
- AI outputs are informational and advisory in nature; they do not substitute for legal, financial, or professional advice.
- Market analyses and price estimates are based on historical data and do not guarantee future market conditions.
- Matching suggestions and briefing content are based on algorithmic assessment and do not promise definitive results.
- All final decisions (sale, lease, pricing, client selection, etc.) rest with the user; Propiq assumes no responsibility for such decisions.
4. Liability for Platform Transactions
Users are solely responsible for all actions they perform via the Propiq platform (client communications, portfolio sharing, contract processes, sales and rental activities, etc.).
- Legal and criminal liability arising from any transaction or action on the platform belongs to the user; the user acknowledges, declares, and undertakes that Propiq bears no responsibility in this regard.
- Propiq is not a party to disputes between users and their clients and cannot be held responsible for such disputes.
- The user is responsible for ensuring that transactions performed via the platform comply with applicable legislation.
5. Third-Party Service Providers
Propiq uses third-party service providers (Supabase, Anthropic, Apple App Store, Google Play, and others) to deliver its service. Propiq's liability for outages, data loss, errors, or security vulnerabilities originating from these providers is limited to the maximum extent permitted by law.
- For issues arising from subscription payments processed through Apple or Google, the relevant app store policies apply.
- AI outputs rely on third-party model providers; no additional warranty is given for the accuracy of these outputs.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Propiq shall not be liable for:
- Direct or indirect damages (loss of revenue, loss of business, data loss, reputational harm, etc.)
- Damages arising from temporary or permanent unavailability of the platform
- Damages arising from the user's relationships with third parties
- Losses resulting from the service failing to meet expectations
Propiq's maximum total liability is limited to the subscription fees paid by the user in the 12 months preceding the event giving rise to the claim.
