Kullanım Koşulları

1. Taraflar ve Kapsam

Bu Kullanım Koşulları ("Koşullar"), Propiq ("Şirket", "biz") tarafından sunulan propiq.network adresindeki SaaS platformuna ("Hizmet") erişim ve kullanım koşullarını düzenler. Hizmete erişerek veya hesap oluşturarak bu Koşulları kabul etmiş sayılırsınız.

2. Hizmet Tanımı

Propiq, emlak profesyonellerine yönelik yapay zeka destekli bir CRM, portföy yönetimi ve piyasa analizi platformudur. Hizmet; müşteri takibi, portföy yönetimi, AI piyasa analizi, komisyon raporlama ve sesli not özelliklerini kapsar.

3. Hesap Oluşturma ve Güvenlik

Hesap oluştururken doğru ve güncel bilgi sağlamakla yükümlüsünüz.
Hesabınızın güvenliğinden ve hesabınız üzerinden gerçekleştirilen tüm işlemlerden sorumlusunuz.
Şüpheli erişim durumunda derhal destek@propiq.network adresine bildirmelisiniz.
Bir hesabı birden fazla kişiyle paylaşmak, abonelik planınızın kullanıcı limitini aşmak yasaktır.
Kayıt sırasında ve platform kullanımı boyunca girdiğiniz tüm bilgilerin (müşteri bilgileri, portföy detayları, fiyatlar vb.) doğru ve güncel olduğunu kabul etmiş olursunuz. Yanlış veya yanıltıcı bilgi girilmesinden doğan her türlü sorumluluk kullanıcıya aittir.

4. Kullanım Kuralları

Hizmeti kullanırken aşağıdaki faaliyetler yasaktır:

Yasa dışı, yanıltıcı veya zararlı içerik oluşturmak ya da yaymak
Platformun güvenlik mekanizmalarını atlatmaya çalışmak
Otomasyon, bot veya scraping araçlarıyla sistemlere aşırı yük bindirmek
Başka kullanıcıların verilerine yetkisiz erişim sağlamak
Hizmeti rakip bir ürün geliştirmek amacıyla tersine mühendislik yapmak

5. Abonelik ve Ödeme

Ücretli abonelikler, seçilen plan dönemine (aylık veya yıllık) göre faturalandırılır.
Ödemeler, güvenli ödeme altyapısı üzerinden işlenir. Kart bilgileri Propiq sunucularında saklanmaz.
Fiyatlar önceden haber verilmeksizin değiştirilebilir; mevcut abonelik dönemine yansıtılmaz.
Aboneliğinizi istediğiniz zaman iptal edebilirsiniz; iade koşulları için İade Politikamızı inceleyiniz.

6. Fikri Mülkiyet

Propiq platformu, tasarımı, logosu, yazılımı ve içeriği Şirket'e aittir ve telif hakkı yasalarıyla korunmaktadır. Hizmeti kullanmak, herhangi bir mülkiyet hakkı devretmez. Kullanıcıların platforma yüklediği içeriklerin (fotoğraf, metin vb.) mülkiyeti kullanıcıya aittir.

7. Gizlilik

Kişisel verilerinizin işlenmesi hakkında ayrıntılı bilgi için Gizlilik Politikamızı inceleyiniz. Hizmeti kullanarak Gizlilik Politikasını kabul etmiş sayılırsınız.

8. Platform İşlemlerinden Doğan Sorumluluk

Propiq, platform üzerinden gerçekleştirilen müşteri iletişiminin, portföy paylaşımının ve satış/kiralama süreçlerinin doğruluğunu, güncelliğini veya kullanıcı beyanlarını garanti etmez. Bu süreçlerin sorumluluğu tamamen ilgili kullanıcıya aittir.

Kullanıcıların platform dahilinde yaptığı her işlem ve eylemdeki hukuki ve cezai sorumluluk kendilerine ait olup Propiq'in bu konuda herhangi bir sorumluluğu bulunmadığını kullanıcı kabul, beyan ve taahhüt eder.
Propiq, kullanıcılar ile müşterileri arasındaki anlaşmazlıklara taraf olmaz ve bu anlaşmazlıklardan sorumlu tutulamaz.

9. Garanti Reddi ve Sorumluluk Sınırı

Hizmet "olduğu gibi" sunulmaktadır. Propiq, belirli bir amaca uygunluk, kesintisiz erişim veya hatasız çalışma konusunda garanti vermez. Yasaların izin verdiği azami ölçüde Propiq'in toplam sorumluluğu, son 12 ayda ödediğiniz abonelik bedeliyle sınırlıdır.

10. Hizmet Kesintileri ve Değişiklikler

Propiq, önceden bildirimde bulunarak veya bulunmaksızın hizmetin herhangi bir bölümünü değiştirme, askıya alma veya sonlandırma hakkını saklı tutar. Planlı bakım çalışmaları mümkün olduğunca önceden duyurulur.

11. Hesap Feshi

Bu Koşulları ihlal etmeniz halinde hesabınız uyarı verilmeksizin askıya alınabilir ya da kapatılabilir. Hesap kapatıldığında verileriniz 30 gün süreyle saklanır; bu süre içinde dışa aktarma talebinde bulunabilirsiniz.

12. Uygulanacak Hukuk

Bu Koşullar Türk Hukuku'na tabidir. Anlaşmazlıklar öncelikle müzakere yoluyla çözülmeye çalışılır; çözüme kavuşturulamazsa İstanbul mahkeme ve icra müdürlükleri yetkilidir.

13. Değişiklikler

Koşullarda yapılacak önemli değişiklikler en az 30 gün öncesinden e-posta ile bildirilir. Değişiklik sonrası hizmeti kullanmaya devam etmeniz, güncel Koşulları kabul ettiğiniz anlamına gelir.

1. Parties and Scope

These Terms of Service ("Terms") govern access to and use of the SaaS platform at propiq.network ("Service") provided by Propiq ("Company", "we"). By accessing the Service or creating an account, you agree to these Terms.

2. Service Description

Propiq is an AI-powered CRM, portfolio management, and market analysis platform for real estate professionals. The Service includes customer tracking, portfolio management, AI market analysis, commission reporting, and voice note features.

3. Account Creation and Security

You must provide accurate and up-to-date information when creating an account.
You are responsible for the security of your account and all activity that occurs under it.
You must notify destek@propiq.network immediately of any suspected unauthorized access.
Sharing an account among multiple people or exceeding your plan's user limit is prohibited.
You acknowledge that all information entered during registration and throughout your use of the platform (customer data, portfolio details, prices, etc.) must be accurate and current. Any liability arising from false or misleading information rests solely with you.

4. Acceptable Use

The following activities are prohibited when using the Service:

Creating or distributing illegal, misleading, or harmful content
Attempting to bypass security mechanisms of the platform
Overloading systems with automation, bots, or scraping tools
Gaining unauthorized access to other users' data
Reverse engineering the Service to develop a competing product

5. Subscriptions and Payment

Paid subscriptions are billed according to the selected plan period (monthly or annual).
Payments are processed through a secure payment infrastructure. Card details are not stored on Propiq servers.
Prices may change with advance notice; changes do not apply to the current subscription period.
You may cancel at any time; see our Refund Policy for terms.

6. Intellectual Property

The Propiq platform, design, logo, software, and content are owned by the Company and protected by copyright law. Using the Service does not transfer any ownership rights. Users retain ownership of content they upload to the platform (photos, text, etc.).

7. Privacy

For details on how your personal data is processed, please see our Privacy Policy. By using the Service, you accept the Privacy Policy.

8. Liability for Platform Transactions

Propiq does not guarantee the accuracy, currency, or validity of customer communications, portfolio sharing, or sales/rental processes conducted through the platform. Responsibility for these processes rests entirely with the relevant user.

Legal and criminal liability for any transaction or action carried out on the platform belongs to the user; the user acknowledges and agrees that Propiq bears no responsibility in this regard.
Propiq is not a party to disputes between users and their clients and cannot be held liable for such disputes.

9. Disclaimer and Limitation of Liability

The Service is provided "as is." Propiq makes no warranty regarding fitness for a particular purpose, uninterrupted access, or error-free operation. To the maximum extent permitted by law, Propiq's total liability is limited to the subscription fees you paid in the last 12 months.

10. Service Interruptions and Changes

Propiq reserves the right to modify, suspend, or terminate any part of the Service with or without prior notice. Planned maintenance is announced in advance where possible.

11. Account Termination

If you violate these Terms, your account may be suspended or closed without warning. Upon closure, your data is retained for 30 days during which you may request an export.

12. Governing Law

These Terms are governed by Turkish Law. Disputes will first be resolved through negotiation; if unresolved, Istanbul courts and enforcement offices have jurisdiction.

13. Changes

Material changes to these Terms will be notified by email at least 30 days in advance. Continued use of the Service after changes constitutes acceptance of the updated Terms.
